Spouse

Your wife or husband. You must be legally married in your home country before your I-140 is filed (usually 12–18 months after starting the program).
If you are not legally married, your partner cannot be included.

Children

Your biological children must be unmarried and under 21 years old when we file the application.
If you and your spouse are no longer together, your biological children can still be added.

Stepchildren

You must have married your spouse before the child turned 18. The stepchild must also be unmarried when we file.

Adopted children

The adoption must have been completed before the child turned 16, and they must be unmarried when we file.

Consular Processing

Consular Processing means you and your family finish your Green Card process at the U.S. Embassy or Consulate in your home country.

If you are working in the U.S. with an H-2A/B, TN, H-1B or L-1 visa, your employer and ULS will help you start the EB-3 (Green Card) process while you are still here.

Later, when it is time for the final step, you will travel back home for a short period to complete your interview and get your visa.

What Happens During Consular Processing

  1.  ULS and your employer finish all the government steps in the U.S. first.
  2.  When your case is ready, the U.S. Embassy in your home country (for example, in Guatemala, El Salvador, Honduras, or Mexico) will contact you for an interview date.
  3.  You will:
    • Submit your documents and medical exam results.
    • Have your fingerprints and photo taken.
    • Speak with a U.S. consular officer who reviews your case.
  4.  When approved, the officer will place an Immigrant Visa inside your passport.

With this visa, you and your family return to the U.S. as Permanent Residents – no longer on temporary H-2B status.

When you arrive at the airport or border, immigration will process your entry, and a few weeks later, your Green Card will be mailed to your U.S. address.

What About My Family?

Your spouse and unmarried children under 21 can go through the same process at the same time as you.
They will each have their own interview and visa issued.

If your family is already in the U.S. with legal visas, they can sometimes choose Adjustment of Status instead – but if they are back home, Consular Processing is how they join you permanently.

Adjustment of Status

Adjustment of Status means you and your family finish the Green Card process while staying in the United States.

If you are already working in the U.S. with your H-2A/B, TN, H-1B or L-1 visa, this process allows you to stay here legally while your employer and ULS help you apply for your EB-3 Green Card.

You do not need to travel home for your interview.

During Adjustment of Status

  • You will send your forms and documents to USCIS (U.S. immigration).
  • You’ll attend a short appointment for fingerprints and photos.
  • You can receive a Work Permit and a Travel Permit (called Advance Parole) while waiting.
  • When your case is approved, your Green Card will be mailed to your U.S. address.


If your spouse or unmarried children under 21 are also in the U.S. with legal visas, they can apply for Adjustment of Status too.

This allows your whole family to stay together and receive their Green Cards at the same time.

How to Bring Your Family to the U.S. First

If you want your family to process with you inside the U.S., we can help them get a travel visa (B-2).

They must visit at least once before it’s time to apply for their Green Cards in the U.S. to avoid problems with the Embassy.
